In any event, the Company's aggregate liability to any Member for any single claim shall not exceed the net real-money deposits made by that Member in the 30-day period immediately preceding the date on which the relevant claim arose.
This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which the Company is incorporated. Any dispute arising out of or in connection with this Agreement — including any question regarding its existence, validity, or termination — shall first be referred to the Company's internal dispute-resolution team for good-faith mediation.
If a dispute cannot be resolved through internal mediation within 30 calendar days of the initial written complaint, either party may pursue resolution through binding arbitration under the rules of a mutually agreed arbitral institution. The language of arbitration shall be English. Members based in Indonesia acknowledge that local regulatory restrictions on online gambling may affect the enforceability of certain provisions; the remainder of the Agreement shall nonetheless continue in full force.
Nothing in this clause shall prevent the Company from seeking urgent injunctive or other equitable relief in any court of competent jurisdiction.
The Company may amend these Terms & Conditions at any time. Where changes are material, we will provide at least 7 days' notice via in-platform notification or the registered email address on file. Your continued use of the Platform after the effective date of any amendment constitutes acceptance of the revised Agreement.
If any provision of this Agreement is found by a court or arbitrator of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or — if modification is not possible — severed from the Agreement. The validity and enforceability of all remaining provisions shall not be affected.
The Company's failure to enforce any right or provision of this Agreement shall not constitute a waiver of that right or provision in respect of any future occurrence.
